The Employment Rights Bill, expected to be introduced by 12th October 2024, will bring significant changes to UK employment law as part of Labour’s New Deal for Working People. One of the most notable changes includes granting “day one” employment rights, such as protection against unfair dismissal from the first day of employment. However, employers will still be permitted to implement probationary periods. It is anticipated that the full enactment of these changes will likely occur by October 2025 or April 2026.

Currently, employees must have two years of continuous service to claim unfair dismissal. Labour’s proposal aims to remove this requirement, providing workers with immediate protection. While this does not prohibit fair dismissals or affect the ability to have probationary periods, it emphasizes that newly hired workers should not be dismissed without just cause. The intent is to create a more fluid job market, allowing employees to move around. Consequently, employers may need to adopt a more vigilant approach to recruitment, induction, and probation to promptly address any capability concerns.
